1. General

Bidyell.com is an online auction service provided by BIDYELL.COM Ltd. Bidyell collects your data solely in compliance with the Privacy and Electronic Communications Regulations.

Any participant may visit Bidyell.com at any time without being a registered member. However, in order to enjoy the full functionality of the Bidyell.com website, registration is recommended.

From every visit made to the Bidyell website, the Bidyell servers save data in an anonymous format - the relevant information being the website that the visitor was linked to us from, any websites that such visitor may proceed to from our site, and the IP address of the visitor at the time of his visit. Furthering this, no personal data is linked with the visitor and anonymity is preserved.

However, we do need some personal information from you so that you can actively participate on Bidyell.com. We would therefore like to request that you agree to the collection and storage of some of your data. Your consent is revocable at any time.

To register with Bidyell you will have to create an individualised ‘User Name’ and password; which in turn enables you to take advantage of all of our services.

2. Data Collection

To be able to identify you we will have to collect certain personal data including your name, address, date of birth, e-mail address etc. With your consent, personal data is recorded and processed by Bidyell, in particular:

• When you register with Bidyell
• When you buy bids
• When you win an auction
• We will only collect your account or credit card data if this is necessary in order to process payment.

Usage data are personal data that identify the user, as well as information on the Bidyell services the user uses, for example your Bidyell user name together with the associated password when you purchase bids or win an auction. This data is no longer stored when it is not required and data is only collected and stored when it is necessary to do so.

3. Use of Personal Data

Personal data such as name, address, etc. are used for delivery purposes once an auction has been won. We ask for your e-mail address so we may contact you when necessary. We need your account data or credit card data to process payment transactions and they will not be used for any other reason. We also use your personal data to communicate with you regarding orders, to process auctions, marketing information and to process other transactions. We also use your data to inform you of marketing promotions or to enable third parties authorized by us to perform technical, logistical, or other services. All data is stored securely on servers.

4. Forwarding Personal Data to Third Parties

Bidyell will only forward your Personal Data to third parties when necessary to process a payment transaction, delivery and shipment of auctioned items, or other relevant business transaction concerning Bidyell.

In other circumstances, Bidyell will only forward your personal data with your express consent or if required to do so by law, i.e. criminal proceedings etc.

5. Viewing or Changing Personal data

Information can be viewed in your Bidyell account at any time and may be update when necessary using your Bidyell user name and your password.

Once you have corrected the data on your account, we will adjust incorrect data accordingly.

6. Revoking Consent or Deleting Your Account

Consent to store and process your personal data is revocable at any time and must be intimated to Bidyell at customerservice@bidyell.com. The revocation is effective immediately.

You can delete or deactivate your Bidyell account at any time. When you delete your membership, your personal data is removed from our database unless we are required to save the data. For your information to be completely removed from our records it can take up to 2 or 3 working days.

7. The Use of Cookies at our Website

Bidyell uses "cookies", which are files that are stored on your computer that can be retrieved to assist in customizing your experience. The information saved supports the functionality of the site, for example by keeping track of your visual preferences or controlling the frequency of "pop-up" windows. These cookies are deleted once you close your web browser. Though cookies may not be absolutely necessary to access the website, if they are disabled the functionality of the website may be affected.

8. Security Measures

The information in your Bidyell account and in your Bidyell profile is password protected, so that only you have access to this personal information. Please note that you are not permitted to provide your password to anyone else. Bidyell will never ask for your password in e-mails that you receive unexpectedly or that you did not request. Please remember to log out of your account and to close your internet browser window when you leave the Bidyell site; this is especially important if you use a PC in public locations. We assume no liability for the abuse of login data and passwords used.

9. Protection from Web Crawlers or Spam

Bidyell assures you that your e-mail address will only be used with your express consent only for the purposes stated in the Terms of Use. We will not sell your e-mail address to third parties, and we will prevent your e-mail address from being recorded by "web crawlers" or "web spiders" to the best of our ability. If you believe that your e-mail address has been recorded in this way, please let us know immediately.

10. Privacy Policy Changes

Any changes to the Privacy Policy will be declared on the Bidyell website.
